Introduction
All teaching/coaching services and communication, email or otherwise, delivered by Cian Kenshin, and/or any directors/staff of Cognitive Technology Consulting Inc.(hereinafter The "Coach"), as well as information on the website are meant to help you identify the areas in your life and in your thinking that may be preventing you from experiencing greater well-being and moving forward. Coaching is not a substitute for professional mental health care or medical care. The term 'coaching' as here used covers life coaching, meditation coaching, Zen coaching, personal coaching, relationship coaching, sensuality and sexuality coaching, ritual practice coaching, Tantra energetic coaching, spirituality coaching, executive coaching, business coaching, breathwork, somatic bodywork, yoga, and reiki for clients.
By using the mindhacker website and services, you agree to be bound by these Terms of Service as well as Substack's Terms of Use. In the event of any conflict between these Terms and Substack's Terms, Substack's Terms shall govern with respect to your use of Substack's platform.
Coaching Disclaimer
The Client understands that the coaching services the Client will be receiving from the Coach are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat, or cure any mental health or medical conditions. The Client also understands that the Coach is not acting as a mental health counselor or a medical professional. For legal purposes, the Client understands that coaching is currently an unregulated industry and that my Coach is not "licensed " by any Canadian, US, EU, or any other country's governing body even though the sessions may take place in Canada, the US, EU, online, or abroad.
The Client understands and agrees that they are fully responsible for their well-being during coaching sessions, and subsequently, including for their own choices and decisions. The Client understands that coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment, and will not use it in place of any form of therapy.
Intellectual Property
You own the original content you post on the mindhacker Substack. By posting content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute your content in order to provide and promote the mindhacker services. This license authorizes us to make your content available to the rest of the world and to let others do the same. You agree that this license includes the right for Substack to provide, promote, and improve its services and to make your content available to other companies, organizations, or individuals who partner with Substack for the syndication, broadcast, distribution, or publication of content on other media and services.
Termination
Both you and mindhacker/Cognitive Technology Consulting Inc. may terminate this agreement at any time with notice to the other. On termination, you lose the right to access or use the mindhacker services on Substack. The following shall survive termination:
Our rights to use and disclose your feedback;
Subscribers and/or Clients' rights to further re-share content and information you shared through the service to the extent copied or re-shared prior to termination;
Any amounts owed by either party prior to termination remain owed after termination.
You can delete your mindhacker account through your Substack account settings. Substack's termination provisions will apply with respect to your use of the Substack platform.
Limitation of Liability
To the maximum extent permitted by law, mindhacker/Cognitive Technology Consulting Inc. shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any content obtained from the services; or (iii) unauthorized access, use or alteration of your transmissions or content.
In no event shall mindhacker/Cognitive Technology Consulting Inc.'s aggregate liability exceed the greater of one hundred U.S. dollars (u.s. $100.00) or the amount you paid mindhacker/Cognitive Technology Consulting Inc., if any, in the past six months for the services giving rise to the claim.
Disputes
You agree that the laws of the Province of British Columbia, Canada, excluding its conflict of laws rules, shall exclusively govern any dispute relating to this Agreement and/or the Services. You agree that claims and disputes can be litigated only in Vancouver, British Columbia, Canada, and you consent to the exclusive jurisdiction and venue of the courts located in Vancouver, British Columbia, Canada.
For any dispute with mindhacker/Cognitive Technology Consulting Inc., you agree to first contact us at [email protected] and attempt to resolve the dispute with us informally.
Other Terms
These Terms of Service constitute the entire agreement between you and mindhacker/Cognitive Technology Consulting Inc. with respect to the subject matter hereof. If any provision of this Agreement is held invalid or unenforceable, that provision shall be construed in a manner consistent with applicable law to reflect the original intent, and the remaining provisions of this Agreement shall remain in full force and effect.
Any failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. This provision shall not affect Substack's rights and obligations under its Terms of Use.
